Appeal Uncertainty and Underwriter Stance
Insurance Business reports that rival clubs and players exploring compensation claims against Manchester City may have to wait for the resolution of the club's appeal before securing after-the-event (ATE) insurance. Following an independent commission's finding that Manchester City breached over 100 Premier League rules, the club lodged an appeal and denies wrongdoing. Rocco Pirozzolo, managing director and underwriting director at Harbour Underwriting, told Insurance Business that the live appeal creates uncertainty and expects underwriters to wait for the final outcome.
Causation and Financial Loss Hurdles
According to Insurance Business, Pirozzolo noted that proving a rule breach is only the first hurdle, with claimants facing the challenge of connecting that breach to a different sporting outcome and translating it into a financial loss. While Burnley's successful award against Everton provides a roadmap for assessing such claims, the novelty of these cases may still fall outside the appetite of certain ATE insurers until causation evidence and the timing of appeals are fully settled, as reported by Insurance Business.
